COVID Mitigation Update

Good evening District 45 Community,

The Centers for Disease Control and the State of Illinois updated their masking guidance this past weekend.

Beginning tomorrow, Monday, February 28, masks are optional and no longer required on District 45 First Student and Septran school buses.

Dear District 45 Community,

I’m writing to update you on the lawsuit ruling that challenged state-mandated COVID-19 mitigations.

On February 4, 2022, the Sangamon County Circuit Court granted a temporary restraining order (TRO) affecting certain school districts and specific individuals in those districts. The TRO temporarily suspended enforcement of mask mandates for students and exclusion for asymptomatic close contacts. Our District was a party to that case. The case is being appealed, and a request to stay the court’s TRO ruling has been filed. As a result, a final and certain outcome has not been reached at this point.

While our District 45 Board of Education voted in August of 2021 to follow CDC, IDPH, and ISBE guidelines and the Board continues to support the mitigations our District had in place, this ruling has compromised the Board’s authority to enforce this policy.

What does this ruling mean?

Temporarily, the ruling means that District 45 and other Illinois school districts cannot enforce the use of masks in school for students and staff. District 45 can continue with in-person instruction and many current mitigations, including the ability to exclude symptomatic individuals and implement social distancing. However, based on the judge’s ruling, the following mitigations remain strongly recommended, but not required:

  • Mask-wearing by students and staff;
  • Quarantine or isolation for those identified as close contacts with no symptoms;
  • Weekly testing for unvaccinated staff

How has District 45 responded?

While we continue to monitor the case’s status, in light of the court’s TRO, we have determined that the least disruptive approach is to temporarily suspend enforcement of the mask mandate and exclusion for asymptomatic close contacts. This will take effect starting Monday, February 7, 2022, and will help ensure continuity of in-person instruction.

District 45 will continue with other mitigation efforts in place, including the ability to exclude symptomatic individuals and implement social distancing. Masks will be available for any student requesting one.

All school visitors will be required to wear a mask. For sports, band, and extracurricular activities, masks are strongly recommended but not required. For events taking place in other locations outside District 45, participants should follow the rules at the location where the event is taking place.*

We will continue to commit to deep cleaning protocols (CDC Guidelines on Cleaning). All students and staff will have access to disposable medical-grade masks, disposable gloves, antimicrobial wipes and all other cleaning supplies, and all classrooms are equipped with ionization units.

District 45 will continue to publish the enhanced version of our COVID-19 Dashboard that provides a current look at positive cases at each school and is updated every 12 hours.

I also want to emphasize that appeals to this ruling are underway, and the ruling is by no means a final determination but an interim step. Within two weeks, an appellate decision will provide further clarity.

If a stay of the TRO is granted or the ruling is reversed on appeal, we will immediately resume enforcement of the COVID-19 requirements for masking and exclusion of close contacts.

Without question, news of the ruling will be met with various responses from our community. Please understand that just as we were previously bound by state mandates to require mask-wearing on school grounds, we are now bound by this ruling.

For the past two years, the District 45 community has been doing its best to keep up with the ongoing changes in state guidance, mandates, and executive orders related to the pandemic. Throughout all of the changes, our goals have been to maintain a safe school environment, keep students in school learning, and provide a consistent, nurturing environment for all students.

Thank you to the many families who, in the days ahead, will help our District minimize the disruption this ruling might cause to our educational environment, focus on the education of our students, and treat every individual with respect, support and care.

Le escribo para actualizarle sobre la decisión de la demanda judicial que desafió las mitigaciones COVID-19 obligatorias por el estado.
